No Driving in Swales between Homes

Subject: [Live Oak Estates HOA Forum] New comment on Phase 4

People in LOE, especially neighbors in phase 1-3, need to STAY out of peoples back yards in phase 4.  We are always noticing folks driving golf carts/atv's etc behind my house it is still my property even though it is also used as a utilities easement.  It is not a recreational path.  You are trespassing on other people's properties!!!

Please pass on and stay off our property.  Besides, if you are not invited into phase 4 you should not be back here, that is why we pay extra dues to stay private!

Phase 4 Representative: Versaci

Over the last 2 weeks emails have gone back and forth as to who will represent the homeowners in Phase 4 of Live Oak Estates.  The results are in:  Brian Versaci will take the lead, and Shawn Hammack will assist. 

   I look forward to working with ICI and Speciality Management on all matters pertaining to Live Oak Estates, and request that I attend any meeting that involves this community.

Q & A for 4/13/10

The attachment will show the compiled list of questions homeowners have submitted for Specialty Management and for the LOEHOA board to answer at the upcoming meeting.  I am looking forward to meeting all residents on Tuesday, April 13th,  at 6 PM at the VFW on Goldenrod.

Questions some homeowners would like to have answered at the meeting on 4/13/10:

1. Boats and cars under repair are visible from the street, against the covernments, even though there is a fence, the top of the boat is visible.  What measures will be taken in the future??

2. There are aluminum/wood sheds on some homeowners property, against the covernments.  All sheds should look like the original house, please address this.

3. Some homeowners are requesting a web site dedicated to Live Oak Estates.  This can be accomplished through "GO DADDY" or similar site.  The cost is insignificant, but the savings could be monumental.

4. Please show a detailed breakdown of all monies spent by Live Oak Estates Homeowners Association.

5.  Please ask Charlie O'Sullivan to address the $3000 that was left over from having the Sheriff's office perform security at the phase 4 gates.

6.  Why was the management changed from Don Asher to Specialty Management.
7.  The entry gate was never properly fixed.  It is still bent and one of the gate metal bars is broken.  I believe the gate needs to be replaced because it will be difficult to fix it in the shape it is in.
 8.  The landscaping at the front gate looks terrible.  Are there any plans to improve this.  If so, now (spring time) is the time to address it.

9. A concern I would like addressed is the white fence on Bella Lane.  The decision at mediation was for the fence to be removed by Jan.  It is my understanding, before entering mediation both parties agree, a mediators decision is final.  There should be no further need for discussion.  This is definitely against our governing rules.       
10. I would like to discuss the possible installation of a security camera at the entrance. Yesterday, Easter Sunday, some people were trying to follow us in to get to the sales office. We told them the office was closed and they backed off. But anyone can get in anytime and it looks like the gate may have been hit again this weekend. A camera would record this action. 

11. Something needs to be done to block foot access/ATV access to the neighborhood. There is one man who drives a tan Ford SUV that parks in front of the gate and walks around to fish in the front pond on a regular basis. Also, I am tired of people driving their ATVs through my backyard. This is not a recreational park - it is a neighborhood.

12. If Rambling Oak Blvd gets connected in the future to Innovation Way developments, what are plans to gate this end of phase 4?

Mr. Jordan,
I’m pleased to see that you have planned to meet with the homeowner of Live Oak Estates,  As I haven’t seen any progress on the issues I  previously raised, I am requesting that they be addressed at the Homeowner meeting on 04/13/2010. Below are my restated requests:


*          Perform Financial Audit A full accounting/audit of the receipt and
expenditures of the homeowner's dues from 2003 to present is requested.  As
 identified in Florida Statue 720.303 this task is to be performed and reported out annually.
To my knowledge there has never been a published audit performed in my fifteen years of living in Live Oak Estates. The purpose of this audit request is to identify any misappropriating, misuse, misstatement and any non-receipt of funds.

*          Provide the justification for the increase in dues. Since 2008 our dues have increased approximately 32%, going from $235 to $311 per year. Yet no new common areas or infrastructure have been added that would require additional maintenance.  It is my analysis that the LOHOA has been running a surplus (revenues greater than expenses) since 2001, and yet no refund or reductions in dues were ever proffered.

*          Front Entryway Lights
 The front entryway lights of phases I and II are either missing altogether or are inoperable. When will this condition be corrected?
                        
 *          Front Entryway Lawn And Flower Beds
 The front entryway lawn and flower beds of phases I and II have deteriorate appreciably. The lawn has dead spots and is weedy. The annuals that were planted in Oct. '09 were very sparsely planted and missing altogether on one side of the Phase I entryway. All the
beds are infested with weeds and need attention. When will this condition be corrected?
                       
*          Deteriorated Fence:
 The fencing along the southern border of Live Oak Estates subdivision, running parallel to Lake Mary Jane Road is in disrepair. Some sections of the wood railing have deteriorated to the extent that it has fallen to the ground; other sections are missing in their entirety. The missing sections were either never installed or have deteriorated to the point that the homeowner had it removed of their own accord.  Deterioration may be due to inferior materials used in building the fence, the lack of timely maintenance i.e. painting/staining,
washing and not applying any chemical preservatives, or simply neglect. When will the fence be repaired and completed or replaced and properly maintained?
                       Note: The completion of the fence should be at the developer expense.
                        
*          Communications
 Provide regular communications between homeowners and ICI developer and Property Management. There hasn't been a LOHOA Meeting is over seven (7) years.  Email communication is a remarkable, acceptable, and inexpensive medium.

*          Contact Listing
Provide a listing of the LOHOA Board Of Director, and Property Managements representatives. The list is to contain the names, titles, address, email address, phone numbers and responsibilities.

*          Change Request Procedures
Develop procedures for requesting community changes while the Developer, ICI controls the Homeowners Association

*          Community rules and enforcement

We will add your items to the list that the others had and forward them to the Board.

Just to clarify, we received your letter earlier this year with the issues that you noted below and shortly thereafter you visited our office and we helped to go through all of the association records that were provided to us by the previous management company.  We had copies made of many of these records for you and it was our understanding that after reviewing the association files and these copies more questions were raised.  It was our understanding that you and others planned to review these records and then readdress the board with your concerns in light of the additional information that you had gathered.  We asked shortly thereafter if you still wanted a response to your original inquiry or whether you were going to send in a new updated and more thorough request but we did not get a response back.  

We are here to help the homeowners and the Board in any way that we can and will work with the Board to address your concerns.

 You are right in that I have not gotten back to you in the timeliest manner and that we reviewed many of the association records.
   To summarize, it was revealed when reviewing the association records that there were questionable accounting practices, ICI had not been paying their share of dues for Phase IV nor for the one lot they own in Phase III, and it is believed that the homeowners’ dues were increased to cover the ICI shortage of dues not paid. It was also noted that the records do not disclose the ICI nonpayment as a receivable outstanding, which in turn signal they never planned to pay it. Regarding copies of the records provided, some key items were not included i.e. the profit and lost statements and budgets and actual for the years 2007, 2008 & 2009. This is why it is imperative that a complete certified audit be performed to confirm or disprove my beliefs and be in the position to undertake corrective action.

Notice of 2010 Annual Meeting: LOEHOA

To all members,
I have just received an email notification for the annual meeting. Please attend the meeting on April 13, at 6:00 PM, and bring along all your questions for the management company to answer. That's a Tuesday evening.

The location is the VFW Post 4287 at 3500 South Goldenrod Road (Orlando, FL 32822). That's the building on the west side of the street, on the left hand side of Goldenrod as you head north.

The agenda of the meeting will be as follows:

Another Letter to ICI Property Management

John Nee,

In an email dated 2/22/10 to Danielle Pennock, there was mention of an annual meeting to be held for Live Oak Estates. As of today, Friday, 3/19/10 I nor any of my neighbors have received official notice of a forthcoming meeting. If this meeting is to take place, we all would appreciate some form of communication from Specialty Management or the president of the Live Oak Estates Homeowners Association, Charlie O'Sullivan.

On Monday, 3/15/10 I sent to you via email a partial list of concerns we would like Specialty Management to address at the annual meeting. I have requested anyone living in LOE to also bring up issues that concern them pertaining to making our lives here more comfortable.

If it is not possible for Specialty Management to schedule the meeting for Tuesday, 3/23/10 I would appreciate correspondence from you for the delay, plus the date for the meeting.

Letter to ICI's Property Manager

The following is a letter from Phase 4's Brian Versaci addressed to Specialty Management's John Nee which raises questions requiring a response:

Welcome to Live Oak Estates HOA Forum

We are presently "Under Construction," but our intention is for this site to be a very informative message center for all the residents of Live Oak Estates with matters pertaining to the (LOEHOA) Live Oak Estates Home Owner's Association. Insightful and factual entries will soon populate the site with a forum that hopefully encourages comments from all readers. This medium will enable us to better advise and inform our fellow residents of the goings-on at LOEHOA and publish everyone's individual opinions herein.

Hey, everyone! It's our HOA. Let's unite and check out all the details. Do we want to solidify it or let matters drift unaccountably like they have for past 15 years?

Spearheaded by Myrtlewood Drive's own Larry Gresham, a one man task force of...well, Larry Gresham, has uncovered what appears to be a misappropriation of funds by Intervest (ICI). In addition to ICI's lack of communication with our residential members, a portion of our annual dues is being allocated for ICI expenditures beyond our Live Oak Estate phases. The suggestion is that these spent funds need to be either justified or recovered.

Charlie Ringer says "Mutiny! Let's slay the bastards and take it over! I always knew things weren't right." Riley Ringer, the Ringer's adorable cat, was not in attendance due to an early evening lizard patrol.

Bob Stover chortled, "Piece of cake. We just need to see some books! But, speaking of cake, I'm hungry now and have to return to my abode for some dinner."

The newsfeeds are streaming in as we will continue to report developments in this story throughout the evening.

Most of those in attendance wanted to know where John Noone bought his "Visor with Wig," a very dapper addition to his already avant garde wardrobe. Always fashionable, Noone was rather puzzled as to the attention it garnered. "I don't get it." said Noone. "Why, I'm always cool. Visor or no visor." Noone confiscated our reporter's camera insisting on a photo blackout. Said Noone, "If you weren't here for the meeting, you don't deserve to see my new look."
